Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aetherics website, brand, and any content or information made available through it. Please read them carefully before using the Site.

1. Who We Are

Aetherics ("Aetherics," "we," "us," "the Operator") is an independent software development brand operated by a sole individual developer based in the Kingdom of Morocco. Aetherics is a trade name, not a registered corporate entity. References to "Aetherics," "we," or "us" throughout these Terms refer to that individual Operator.

Aetherics designs, builds, and publishes free software products, including but not limited to:

  • Destro — a music listening-together web and desktop application;
  • Steampunk — a watch-together web application;
  • Zenox — an AI agent command-line tool (currently unavailable pending revamp);
  • Auno — a SaaS product (currently in development, not yet publicly available).

This website (the "Site") serves as the public-facing home of the Aetherics brand, providing product showcases, patch notes, and general information about our work. The Site has no account system, no login, and no user-generated content functionality of its own.

Each product listed above is governed by its own dedicated Terms of Service, which take precedence over these Terms for matters specific to that product. These Terms govern the Aetherics brand and Site as a whole.

2. Acceptance of Terms

By accessing or using this Site, you agree to be bound by these Terms and any additional notices or policies referenced herein. If you do not agree to these Terms in full, you must immediately stop using the Site.

Your continued use of the Site following any update to these Terms constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

3. Eligibility

The Site and Aetherics products are intended for users who are at least 13 years of age. By accessing the Site, you represent that you meet this minimum age requirement. We do not knowingly collect or solicit information from anyone under 13. If we become aware that a person under 13 has contacted us directly (for example, via our support email) in a way that involves providing personal information, we will delete that information promptly.

4. The Site — What It Is and What It Isn't

The Aetherics Site is a static informational and showcase website. It contains:

  • A product landing page and hero section highlighting Aetherics products;
  • A patch notes and changelogs page covering updates to our products;
  • A portfolio and showcase page featuring our work.

The Site does not include any of the following: user accounts, registration, or login of any kind; user-generated content, forums, or comment systems; payment processing or e-commerce functionality; any data collection forms beyond what a user voluntarily submits via contact (see Section 7).

5. Our Products and Their Individual Terms

Each Aetherics product is a standalone service governed by its own Terms of Service, independent of but related to these brand-level Terms. By using any Aetherics product, you are subject to both these Terms and that product's specific Terms. In the event of a conflict between these Terms and a product's own Terms of Service, the product-specific Terms take precedence for matters relating to that product.

Products currently under the Aetherics brand:

  • Destro (Web) — governed by the Destro Web Terms of Service;
  • Destro Desktop — governed by the Destro Desktop Terms of Service;
  • Steampunk — governed by the Steampunk Terms of Service;
  • Zenox — currently unavailable; its Terms of Service will be published upon relaunch;
  • Auno — not yet publicly available; its Terms of Service will be published prior to public launch.

We may add, modify, rebrand, or discontinue products under the Aetherics brand at any time.

6. No Tracking, No Cookies, No Accounts

The Aetherics Site does not use cookies, tracking pixels, analytics scripts, session tokens, or any similar technology to collect information about your visit. We do not build profiles of Site visitors, serve targeted content based on browsing behavior, or share visitor data with third parties for advertising purposes.

As with any website delivered over the internet, your IP address and request metadata may be processed by our hosting and content delivery infrastructure (Cloudflare) solely for the purpose of delivering the Site to your browser, governed by Cloudflare's own privacy policy. We do not access, store, or use this data beyond what Cloudflare processes in its own capacity.

7. Contact and Voluntary Communications

The Site provides a support contact address — support@aetherics.dev — for inquiries, feedback, and product support. If you contact us via this address, you are voluntarily sharing your email address and any information included in your message. We use this information solely to respond to your inquiry and do not store, share, or use it for marketing or profiling purposes. We do not add you to any mailing list without your explicit consent.

8. Advertising — Future Notice

Aetherics products and the Site are currently provided entirely free of charge and without advertisements. At an unspecified future date, we may introduce advertising on some or all of our products or the Site. Should we do so, we will:

  • Update these Terms and the relevant product Terms of Service to reflect this;
  • Disclose the identity of any third-party advertising or analytics providers used;
  • Comply with applicable legal requirements, including cookie consent and data disclosure obligations under GDPR and other applicable laws, before activating any advertising infrastructure.

Until such an update is published, no advertising or ad-related tracking is active on any Aetherics property.

9. Intellectual Property

9.1 Brand and Non-Code Assets. All brand identity, trade name, logos, visual design, interface design, written content, documentation, and other non-code assets associated with Aetherics, Destro, Steampunk, Zenox, and Auno are the exclusive intellectual property of the Operator, protected under applicable copyright, trademark, and intellectual property law. No right, license, or interest in these assets is granted to you under these Terms. Unauthorized use, reproduction, or commercial exploitation of Aetherics brand assets without prior written permission is strictly prohibited.

9.2 Open Source Code. Destro's source code is made available publicly on GitHub under the open source license specified in that repository. The terms of that license govern your rights with respect to the Destro source code. Nothing in these Terms restricts rights expressly granted by that open source license. However, the Aetherics and Destro brand names, logos, and non-code assets remain proprietary and are not covered by or granted under any open source license — you may not use the Aetherics or Destro name or branding in any fork, derivative work, or redistribution without our prior written permission.

9.3 Other Product Code. Source code for Steampunk, Zenox, Auno, and any other Aetherics product not expressly published under an open source license remains proprietary. Unauthorized reverse engineering, decompilation, redistribution, or commercial use of such code is strictly prohibited.

10. Acceptable Use of the Site

By accessing the Site, you agree not to:

  • Attempt to disrupt, overload, or interfere with the Site's infrastructure, including through denial-of-service attacks, scraping, or automated crawling beyond what is reasonable for indexing purposes;
  • Use the Site to transmit malware, spam, or malicious code;
  • Misrepresent your affiliation with Aetherics or impersonate the Operator;
  • Use Aetherics brand assets in any manner that implies endorsement, partnership, or affiliation without our explicit written consent;
  • Attempt to gain unauthorized access to any part of the Site or its underlying infrastructure.

11. Third-Party Links and References

The Site may contain links to third-party websites, platforms, or services (such as GitHub, product demo pages, or external tools). These links are provided for informational convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party website. Accessing third-party links is entirely at your own risk and subject to those parties' own terms.

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT PUBLISHED ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE AT ALL TIMES, FREE OF ERRORS, OR FREE OF HARMFUL COMPONENTS.

INFORMATION ON THE SITE, INCLUDING PATCH NOTES, PRODUCT DESCRIPTIONS, AND SHOWCASE CONTENT, IS PROVIDED IN GOOD FAITH BUT MAY BE OUTDATED, INCOMPLETE, OR SUBJECT TO CHANGE WITHOUT NOTICE. WE MAKE NO WARRANTY REGARDING THE ACCURACY OR CURRENCY OF ANY INFORMATION PUBLISHED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE SITE OR ANY CONTENT THEREON — INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM RELIANCE ON INFORMATION PUBLISHED ON THE SITE, INABILITY TO ACCESS THE SITE, OR ANY THIRD-PARTY CONTENT LINKED FROM THE SITE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SITE IS INFORMATIONAL AND PROVIDED FREE OF CHARGE, THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED MOROCCAN DIRHAMS (100 MAD), OR THE MINIMUM AMOUNT PERMITTED BY LAW, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any claim, liability, loss, damage, or expense (including reasonable legal fees) arising from: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your misuse of Aetherics brand assets or intellectual property; or (d) your violation of any applicable law or third-party rights in connection with your use of this Site.

15. Product Availability and Service Changes

Aetherics products and the information published about them on this Site are subject to change at any time. We may add new products, retire existing ones, rebrand, revamp, or indefinitely suspend any product without prior notice. The listing of a product on this Site — including products marked as in development or currently unavailable — does not constitute a commitment to deliver or maintain that product. We are not liable for any decision you make based on the availability, stated features, or planned roadmap of any Aetherics product.

16. Force Majeure

The Operator is not liable for any failure or delay in making the Site or its products available due to circumstances beyond our reasonable control, including internet or infrastructure outages, third-party service failures, cyberattacks, natural disasters, or governmental action.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or the Site shall be subject to the exclusive jurisdiction of the competent courts of Casablanca, Morocco — except where mandatory consumer-protection law in your country of residence requires otherwise.

18. Informal Dispute Resolution

Before initiating any formal legal proceeding against the Operator, you agree to first contact us at support@aetherics.dev to describe your concern and attempt to resolve it informally. We commit to doing the same. Most concerns can be resolved quickly and without formal proceedings.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

20. No Waiver

Our failure to enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision on any subsequent occasion.

21. Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may freely assign these Terms, including in the event of a transfer, sale, or rebrand of the Aetherics brand or any of its products.

22. Entire Agreement

These Terms, together with the individual Terms of Service of each Aetherics product (where applicable), constitute the entire agreement between you and the Operator with respect to the Aetherics brand and Site, superseding any prior agreement or understanding on the same subject matter.

23. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with an updated "Last Updated" date. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the changes. If you disagree with any revision, you should stop using the Site.

25. Miscellaneous

Section headings are for convenience only and have no legal effect. These Terms are written in English. Any translation made available for convenience is non-binding, and the English version controls in all cases of conflict, except where mandatory local law provides otherwise.
